These terms govern your use of powersmithsolar.com. By using the site you accept them. If you do not accept them, please do not use the site.

Who these terms are with

This site is operated by Powersmith Energy (Powersmith Solar), 1111 6th Avenue Suite 300, San Diego, CA 92101.

“We”, “us” and “our” mean Powersmith. “You” means anyone using the site.

Using this site

You may use this site to learn about our services and to contact us. You may not:

• Use it for anything unlawful, or in a way that damages or overloads it
• Submit someone else’s personal details without their permission
• Scrape, copy or republish our content, photography or designs without written permission
• Try to gain access to accounts, systems or data that are not yours
• Submit false information, including false referrals

Estimates are estimates, not a contract

Anything this site tells you about system size, production, savings, payback period or price is an estimate produced from the information you gave us and from general assumptions about equipment and utility rates.

Real results depend on your roof, shading, your actual usage, your utility’s rates and rules, equipment availability, permitting and inspection. These change, and some are outside our control.

Nothing on this site is an offer or a binding quote. A binding price exists only in a signed written agreement between you and Powersmith or the installing contractor named in it.

The solar calculator

The calculator is a planning tool. It produces a rough indication from a small number of inputs and should not be used as the basis for a financial decision on its own.

For a real number, ask us for a site-specific proposal.

SMS Consent Communication

If you give us your mobile number and tick the SMS consent box on a form on powersmithsolar.com, you agree to receive text messages from Powersmith Energy. Consent is not a condition of purchase, and you can withdraw it at any time.

The information you give us as part of SMS consent — your mobile number and the consent itself — is not shared with third parties or affiliates for marketing or promotional purposes.

• Marketing and promotional messages about solar panels, battery storage and EV chargers
• Quotes, pricing and special offers
• Follow-up about a quote you have asked for

Message frequency, cost and how to stop

• Message frequency varies.
• Message and data rates may apply.
• To opt out, reply STOP to any message. You will receive one confirmation and no further messages.

Tax credits and incentives

We are not tax advisors, and nothing on this site is tax advice.

Information about the federal Investment Tax Credit, depreciation, state or utility incentives is general and may be out of date. Eligibility, the amount and the rules depend on your circumstances and on legislation that changes.

Confirm anything you intend to rely on with a qualified tax professional before you make a decision.

The referral program

We pay a referral fee for referrals that become completed installations. The current amount is $500 to $1,000 per completed referral, depending on system size.

• You must submit the referral through our referral form or your personal referral link before we have already been in contact with that person
• The person you refer must be a genuine prospect who has agreed to hear from us
• A fee becomes payable once the system is installed and the customer’s contract has been paid, not when the referral is submitted or the contract is signed
• We do not pay for referring yourself, your own household, or a lead we already had
• We may change the amounts, the conditions or the program itself at any time. Changes do not affect a fee already earned
• Referral fees may be reportable income. Handling any tax on them is your responsibility

Accounts

Sales rep and partner accounts are issued by us, not self-registered. You are responsible for keeping your password to yourself and for what happens under your account.

Tell us straight away if you think someone else has access. We may suspend or close an account that is misused, shared, or belongs to someone no longer working with us.

Our content

The text, photography, drone footage, designs, logos and layout of this site belong to Powersmith or are used with permission. Our name and logo are our trademarks.

You may not reproduce them commercially without our written permission. Linking to us is welcome.

Other companies’ sites

Where we link to manufacturers, financiers, installers or review sites, we do not control them and are not responsible for their content or their privacy practices. Their terms apply when you are on their site.

Disclaimers

This site is provided as it is. To the extent the law allows, we make no warranties about it — including that it will be uninterrupted, error-free, or that the information on it is complete or current.

This does not limit any warranty in a signed installation or service agreement with us, and it does not limit any right you have under California law that cannot be waived.

Limitation of liability

To the extent the law allows, Powersmith is not liable for indirect, incidental or consequential losses arising from your use of this site — including lost savings, lost profit or lost data.

Nothing here excludes liability for fraud, personal injury caused by negligence, or anything else that cannot be excluded by law.

Governing law

These terms are governed by the laws of the State of California. Any dispute will be brought in the state or federal courts serving San Diego County, California, and you and we agree to that jurisdiction.

Changes to these terms

We may update these terms. The date at the top shows when they last changed, and continuing to use the site after a change means you accept it.
